SRI.P.V.JAYARAJAN: PRESIDENT

This is a complaint filed under section 35 of Consumer Protection Act 2019 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:

This is a complaint filed by the complainant against the opposite party alleging deficiency in service on the part of the opposite party.  After admitting the complaint notice was issued to the opposite party.  After accepting the notice the opposite party failed to appear before this Commission and hence on 05/07/2022, the opposite party was called absent and set ex parte.  Meanwhile on 16/03/2023 the opposite party filed an application as IA No.101/2023 to set aside the ex parte order passed against him.  And the said application was posted for objection to 12/05/2023.

            Today the complainant filed a memo stating that the matter is settled and he is not willing to further proceed with complaint.  In view of the above referred memo, this Commission suo-moto advanced this case from 12/05/2023 to this dated and the memo of settlement signed by both parties filed by the complainant is accepted and recorded.  In view of the settlement arrived at between the parties to the proceedings, we find that this is a fit case to be dismissed as settled. 

In the result the complaint dismissed as settled.  There will no order as to cost.

A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
