Case of the complainant as made out from the complaint petition in short is that he had obtained a Credit Card facility from the O.P no.1 bearing card no.558983XXXXXX1557 having e.mail ID 2. Having not contested this case, both the O.Ps were set exparte vide order dt.2.10.2022. 3. The points for determination in this case are as follows: i. Whether the case of the complainant is maintainable? ii. Whether there was any deficiency in service on the part of the O.Ps? iii. Whether the complainant is entitled to the reliefs as claimed by him? Point No.ii. Out of the three points, point no. ii being the pertinent one is taken up first for consideration here in this case. On perusal of case record and documents available therein, it is noticed that the complainant had obtained a Credit Card facility from the O.P no.1 bearing no.558983XXXXXX1557 having e.mail ID Pointsno.i& iii. From the discussions as made above, the case of the complainant is maintainable and the complainant is entitled to the reliefs as claimed by him. Hence it is so ordered; ORDER The case is allowed exparte against the O.P no.2 who is liable here in this case. Thus, the O.P no.2is directed to refund the booking amount of the complainant i.e. Rs.25,897.68palongwith interest thereon @ 12% per annum with effect from 27.6.2022. The said O.P. no.2 is further directed to pay a sum of Rs.10,000/- to the complainant towards his mental agony and harassment so also a sum of Rs.5000/- towards the litigation expenses of the complainant within a period of 30 days from the date of receipt of copy of this order.
