This C.C.Case has been filed U/s-12 of C.P.Act, 1986 seeking following relief:-
Honbl’e Commission may direct the Ops to delete the illegal demand of Rs. 2,41,868/- from the bill of Consumer number IKK_III_246 and to accept electricity dues on actual reading raised from time to time. Further direct the Ops to be restrained from disconnecting power supply to Complainant above consumer number.
Brief fact of Complainant’s that Complainant is a consumer under Ops bearing Consumer No. 0191291 of 3kw of power supply from Ops. Thereafter, the said load factor was enhanced to 10kw for smooth running of the restaurant and a new consumer No. was assigned bearing no. IKK_III_246. The Complainant surprisingly received a bill dt. 08.11.2019 which reveals that the Ops have imposed an imaginary amount Rs. 2,41,868/- and addition of bill amount of actual consumption on reading of meter Rs. 4110.82 total amount Rs. 2,45,915/- for a period of 01.10.2019 to 31.10.2019. The complainant complained to the Ops in several times but it yield no effect, but claimed that there was an outstanding in the name of Complainant’s father to which he is liable to pay. In Super Cyclone, 1999 the old consumer number remained disconnect the power supply and father of Complainant approach the Ops to restore the power supply for reason that, the thatched house was totally collapsed and became inhabitable. As such, the agreement in respect of that consumer deems to have been terminated U/S-16 of the O.E.R.C. Regulation and the father of the Complainant surrendered it & agreement was also terminated. Further Ops are supply of power in another land bearing consumer number IKK_III_246 on complainant premises. The addition of outstanding dues in respect of Consumer No. 01023576,which is illegal arbitrary and unfair trade practice so also deficiency in service.
Notice to Ops was sent by Regd. Post but none of the Ops appeared.
We have gone through the record and direct the Ops to settle the dispute by deducting 30% of the bill as is being normally deducted by Ops and complainant shall pay 50% of the amount within 30 days from the date of receipt of this order and rest 50% is to be paid in 10 installments. If the Complainant prays to install a new meter than the average bill of 3/6 months as per the norms of Electricity Act/Rules shall be the basis of average and fresh bill for stipulated period shall be recalculated and in order to take advantage of the order. Complainant has to sent an application within 15 days of receipt of the order or 30 days from the date of passing of the order and Ops shall install a new meter within 15 days thereafter if Complainant faces to submit the application by Regd. Post to Ops then it will be presume that Complainant is not interested for installation of new meter and will be abide by the 1st part of the order.
With the aforesaid observation and direction that, the present C.C.Case No. 5/2020 & IA No. 3/2020 are accordingly disposed off. No order as to cost.
