ORDER

This is a complaint filed under section 35 of Consumer Protection Act 2019 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:
This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. After admitting the complaint notice was issued to the opposite parties. The opposite parties entered appearance and filed written version denying the allegation raised by the complainant. Along with complaint, the complainant filed a stay petition as IA No.38/2021 on 29/01/2021 and this Commission issued an interim order restraining the opposite party from taking any steps to repossess the vehicle bearing No.KL-01-CF-7514 from the possession of the complainant. After entering appearance, the opposite party filed objection to the above said IA. As the complainant was continuously absent and not present for hearing the IA, on 21/05/2022, this Commission cancelled the order passed in IA.38/2021 and dismissed that application. Inspite of giving sufficient opportunities, the complainant failed to file affidavit to further proceed with this complaint. In the above circumstances we find that the complainant is not interested to further proceed with this complaint.
In the result complaint is dismissed for default. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
