By Sri. K. Gheevarghese, President:

The complaint filed for the benefit of the Debt Waiver Scheme which enacted in the year 1989. According to the Complainant the agricultural loan availed by them would have been written off. The benefit of the scheme implemented by the Central Government was not availed by the Complainant. The loan amount taken by the Complainant from the Petitioner Bank became due in 1987 and it was not renewed later. The benefit of the order granting relief for the agricultural loan would have not received by the Complainant. The Opposite Party's bank as such committed deficiency in their service. The complainant has not filed any petition to condone the delay, more over the petition is highly time barred. The cause of action of this complaint starts from 1987 when the loan amount became due. Hence the complaint is dismissed, no order as to cost.
