1. This complaint is filed under section 12 of Consumer Protection Act 1986 and stood over to this date for consideration. After hearing the matter, this commission passed an order as follows.

2. This is a complaint filed by the complainant against opposite party alleging deficiency in service.  After admitting the complaint, notice was issued to the opposite party. After accepting the notice, opposite party filed version. Thereafter the case was posted for proof affidavit of the complainant. As the complainant was continuously absent, a notice was issued to the complainant to appear before this commission today to file proof affidavit. The notice of complainant returned with endorsement “addressee deceased ” and the case was posted for steps. But there was no steps taken.

                  In the above circumstances, we find that the complainant is not interested to further proceed with the complaint.

                 In the result, complaint is dismissed for default. There will be no order as to costs.
