ORDER

Heard the counsel for both the parties who submitted that they intend to settle the claim, where in the first Opposite party has conceded the fact that the original R.C. belonging to the complainant is lost while it was in their custody and therefore they have agreed to get the duplicate R.C. issued to the complainant and for the deficiency of service at their end, they are prepared to pay compensation of Rs.5000/- as agreed by the counsel for the complainant. But, the complainant who is in person submits that for want of the original R.C. he has suffered many times and once he met with an accident he could not make a claim for insurance amount for want of R.C., therefore the compensation offered by the first Opposite party is not adequate. The first Opposite party since conceded the service deficiency at their end in rendering the service and the difficulties that the complainant expressed, we propose to fix a compensation of Rs.8,000/- towards deficiency in service and for mental agony in lumpsum. With the result, we pass the following order. Order Complaint is allowed in part. The first Opposite party is directed to get the R.C. issued to the complainant within 30 days from the date of this order failing which the first Opposite party shall pay Rs.100 per day till the R.C. is issued. The complainant shall on the first Opposite party informing him shall accompany him to RTO, Hassan for signing document without fail. The Opposite party shall also deliver the D.D. for Rs.8,000/- to the complainant within 30 days from the date of this order, failing which he shall pay interest at 9% p.a. from the date of this order till the payment. Give a copy of this order to both the parties according to Rules.
