ORDER

By Smt. Padmini Sudheesh, President: Petitioner availed a loan from the respondent for purchasing a Motor Cycle. The monthly instalment rate is Rs.2321/- and the total instalment is 36. The vehicle purchased by the petitioner is a Bajaj Pulsar – 150 motorcycle vide R.C. No.KL-46/A-605. He has remitted 34 instalments towards the loan and there are arrears of two instalments. The petitioner has right to use the vehicle as his own and nobody has right to disturb it. Nobody has right to seize the vehicle forcibly. Lawyer notice sent on 4.4.08. But on 24.4.08 the respondent and his goondas trespassed to his house and tried to seize the vehicle forcibly. They have no right to do so. Petitioner is ready to pay the penal interest, overdue charge and dues. The R.C. and I.C. are not issued to the petitioner so far. He has right to get it. Hence this complaint. 2. The notice from the Forum is accepted by the respondent. But remained absent. Hence set exparte. 3. To prove the case, petitioner filed affidavit and three documents. The documents are marked as Exts. P1 to P3. 4. There is no evidence to the contrary. 5. So the petition is allowed and the respondent and his men are restrained from forcible seizure of the said vehicle. The respondent is further directed to hand over the R.C. and I.C. to the petitioner. He is also directed to pay Rs.1000/- (Rupees one thousand only) as compensation and Rs.500/- (Rupees five hundred only) towards cost. Time for compliance one month. Dictated to the Confidential Assistant, transcribed by her, corrected by me and pronounced in the open Forum, this the 25th day of June 2008.
