SHRI.M.K.ABDULLA SONA: HON’BLE ACTING PRESIDENT

 

 

This Revision Petition is preferred from the order passed by the CDRF, Thrissur in I.A.633/11 in CC.362/10 dated:14.3.2012.   The revision petitioner is the opposite party and the respondent is the complainant in the above said petition.  On that day this revision petition came before this commission for final hearing, the counsel for the revision petitioner is present and there is no representation for the respondent/complainant.  It is seeing that this revision petition preferred from the order passed by the CDRF, passed exparte order against the revision petitioners/opposite parties due to their non appearance before the Forum on 14.3.2012.  It is submitted by the counsel for the revision petitioner that this is a medical negligence case and the opposite parties are the insurance company came with this revision petition.  It is also submitted that the revision petition is having a solid ground for defend the case hence they want to adduce sufficient evidence.  Due to the order passed by the Forum below in the I.A.633/11, such an opportunity from the part of the revision petitioners is elapsed.  He prays to allow the revision petition and also to set aside the order passed by the Forum below in I.A.633/11.

 

We heard and perused the records available in this case bundle.  It is seeing that the revision petitioner is having an ample grievance including adducing evidence etc in the above said case.

 

In the circumstances, for the interest of justice we allowed this revision petition and also to set aside the exparte order passed by the Forum.  The revision petition disposed accordingly.
