ORDER

By Smt. Padmini Sudheesh, President Petitioner’s case is as follows: Petitioner is a senior citizen having 77 years of age. He and his wife having 67 years of age and his aged mother, has 94 years of age are living together. On the basis of the advertisement in Mathrubhumi daily, the petitioner has contacted the respondent for a home servant. The respondent has agreed to arrange the servant and on 24/10/2007, the petitioner has gone to his office and the respondent wanted to pay Rs.800/- as registration fees and Rs.3000/- as one month’s service charge in advance. He has paid the amount and the receipts are produced. On the basis of it a female servant is sent to his house. But on 1/11/07 the servant gone from his house and never returned. Only 8 days service is availed to the petitioner. He has informed the respondent through telephone but no remedy. The amount is not returned and another servant is also not arranged. His family consists of old aged people and the help of a servant is highly necessary. On the arrival of the new servant, who is arranged by the respondent the petitioner has sent the existing servant. So much difficulties are suffered. Hence the petition. 2. The notice issued to the respondent is returned as unclaimed. On 7/4/08, the respondent is called absent and set exparte. The petitioner is appearing personally. The documents produced by him are marked as Exhibits P1 to P3.. 3. Heard the party and perused the documents’ 4.According to the petitioner he is entitled for the registration fee of Rs.800/and the service charge Rs.3000/-. He also claims Rs.5000/0 as a compensation and costs. There is no counter evidence to the evidence of the petitioner. 5. In the result the petition is allowed and the respondent is directed to return Rs.3,800/- (Rupees Three thousand and eight hundred only) which is received from the petitioner and Rs.2000/- (Rupees Two thousand only) as compensation and Rs.500/-(Rupees Five hundred only) towards costs. Time for compliance one month. Dictated to the Confidential Assistant, transcribed by her, corrected by me and pronounced in the open forum this the 30th day of April 2008.
