The concise fact of the case of the complainant is that the complainant Atanu Roy’s father namely Ajit Roy applied for non-housing loan to the OP, Manager Aadhar Housing Finance Limited which the OP sanctioned on 30.11.2021 for Rs.9,69,019/- and Insurance is Rs.2,836/- and LIC is Rs.70,852/-. All the approval letters were issued in this respect. Out of that loan the OP paid Rs.8,66,132/- to the said Ajit Roy. Subsequently, said Ajit Roy died on 04.01.2022. The complainant as a legal heirs and consumer filed this case. The complainant informed the OP about the death of said Ajit Roy. The OP sent a letter to Ajit Roy on 12.10.2022 along with name of the complainant as first co- borrower and legal heirs. The OP demanded

Rs.10,16,676/- in that letter and also sent a notice for payment of the loan on 11.10.2022. The actual amount is Rs.15,975/- and interest for the period is 07.01.2022 to 02.03.2022. The OP did not pay the insurance money of Rs.70,852/- as LIC to the Insurance Company and Rs.2,836/- as Insurance. It is the duty of the OP to pay the said money but the legal heirs did not receive the LIC money after the death of Ajit Roy. Despite information to the OP they did not give to service and the agreement paper to the petitioner, despite going to their office several times. So the present case is filed. The cause of action for the present case arose on 10.11.2022 and on subsequent date. The complainant prayed for an award the directing the OP to give the Insurance Certificate and LIC Certificate of Late Ajit Roy to the complainant , direction to OP for receiving actual amount from the complainant , direction to handover the original deed other documents of Late Ajit Roy to the complainant, Rs.3,00,000/- towards mental pain and agony and litigation cost.
The OP initially contested the case but subsequently did not file W/V and as such as per order no.7 dated 30.06.2023 the case is decided to be heard ex-parte against the OP.
The complainant in order to substantiate the case adduced both oral evidence in the form of affidavit in chief and documentary evidence in course of trial of this case.
Having perused the case record it is found that one sanction letter was issued to the said Ajit Roy, the deceased father of the complainant with the heading of sanctioning non-housing loan for a sum of Rs.9,69,019/- at an interest of 17.25%. The complianant further proved the pass book of the bank in the name of the complainant. The complainant further stated in evidence that the complainant paid Rs.15,975/- and filed copy of bank pass book to substantiate it. The entire oral and documentary evidence of the complainant stand unchallenged and un-discarded since the case is heard ex-parte against the OP.
Thus having assessed the entire unchallenged evidence and the uncontroverted documentary evidence of the complainant the Commission is of the view that the OP has acted in a manner with the complainant which tantamounts to deficiency in service. The OP could not adduce any evidence on their behalf. So also the OP could not make out any defence case in as much as the OP has not filed any written version due to the case being heard ex-parte against this.
Thus after considering the entire evidence of the complainant which stand unchallenged, the Commission comes to the finding

that the complainant successfully proved the case against the OP upto the hilt ex-parte.
Consequently, the complaint case succeeds ex-parte against the OP.
Hence,
“It is
Ordered
that the complaint case no.CC/25/2023 be and the same is allowed ex-parte against the OP, Manager Aadhar Housing Finance Limited with cost of Rs.5,000/- (Rupees five thousand). The complainant do get an award with a direction to the OP to give the insurance certificate and LIC certificate of Late Ajit Roy to the complainant , without taking any amount from the complainant, further direction to give original deed and other documents of Late Ajit Roy to the complainant, Rs.25,000/- (Rupees twenty five thousand) towards mental pain and agony and harassment and litigation cost of Rs.5,000/- (Rupees five thousand). The OP is directed to pay Rs.30,000/-(Rupees thirty thousand) to the complainant within 30 days from the date of passing the final order failing which the entire award money shall carry an interest of 10% p.a from the date of its passing the final order till the date of its realisation.
All Interim Applications (I.A) stand disposed of accordingly.
