O R D E R

            Case of the petitioner, filed on 28..8..2009, is as follows:
            Petitioner insured his house against fire and theft with the opposite party. After the occurrence of theft petitioner preferred a claim to the opposite party. Opposite party appointed a surveyor but not processed the claim of the petitioner  so far. According to the petitioner the act of the opposite party in not processing the claim of the petitioner is a clear deficiency in service. 
            Opposite party entered appearance and filed version contenting that the claim was not processed because of the non-coperation  of the petitioner. Petitioner had not produce certain documents which are needed   for the processing    the claim like  FIR, Scene Mahazar and estimate of alleged loss. So they pray for dismissal of the petition.

            Heard both sides. In our view the grievance of the petitioner will be redressed if the claim is processed. So we direct the opposite party to issue a new claim form to the petitioner with within 15 days of receipt of the order. Petitioner shall submit the claim along with the necessary documents to the opposite party. Opposite party is directed to settle the claim within 60 days of its submission. If the claim is not processed as ordered  opposite party is liable to pay Rs. 10,000/- as compensation for the deficiency in service .
