O R D E R SRI.K.T.SIDHIQ, PRESIDENT Complaint of Prakashan in brief is that he purchased one Bed for Rs.4300/- and a mixie for Rs.3200/- from opposite party through their agent Shameer. The mixie was purchased by exchanging his old mixie for Rs.800/-. Thus he paid Rs.6700/- for Bed & Mixie. But the mixer grinder became defective within 2 days of its purchase. The mixer grinder was provided with a guarantee of 1 year. Even though he contacted the opposite party over phone several times they told that they will repair the mixer grinder. But till date it was neither repaired nor replaced. 2. The mixer grinder supplied by opposite party was inferior quality and hence uselss. There fore the opposite party is liable either to replace the mixer grinder or to refund the price of the same with a compensation of Rs.10,000/-. 3. Notice to opposite party issued by registered post. It was returned with endorsement Not known. Hence notice through substituted service by publication in a daily is ordered or accordingly publication of notice to opposite party is produced. Even then opposite party remained absent. Hence opposite party set exparte. 4. Prakashan examined as PW1 and Exts A1 & A2 marked. Claim of complainant is proved. Hence the complaint is allowed and the opposite party is directed to refund a sum of Rs.4300/- the purchase price of the mixer grinder with a compensation of Rs.5000/- towards the mental agony, loss and hardships sustained to him along with a cost of Rs.1500/-.
