Complainant purchased a computer from the opposite party for Rs.25,550/- vide Invoice No.130 on 05/07/08. 2 years warranty was also provided. Within 3 months from the date of purchase itself computer started showing defects. After repeated requests opposite party took the parts of the computer for repair. Even then it was not functioning. Complainant filed a complaint before Forum for Consumer Justice, Alathur. A notice was issued by the above organisation for which opposite party sent no reply. Hence the complainant claims an amount of Rs.25,550/- being the price of the computer together with Rs.6,000/- as compensation for the deficiency in service.

2. Opposite party was set ex-parte.

3. Evidence adduced by the complainant consists of the affidavit & Exts.A1 and A2.

4. It is evidence from Ext.A1, Invoice dtd.05/07/08 that complainant has purchased the

said computer from opposite party paying an amount of Rs.25,550/-. Complainant has stated

in the affidavit that 2 years warranty is provided for the computer. Opposite party has not adduced any contra evidence to that one tendered by the complainant. Hence the evidence adduced by the complainant stands unchallenged.

5. In view of the aforesaid circumstances, complaint stands allowed. We direct the opposite party to pay complainant an amount of Rs.25,550/- (Rupees Twenty five thousand five hundred and fifty only) being the price of the computer together with Rs.5,000/- (Rupees Five thousand only) as compensation and Rs.1,000/- (Rupees One thousand only) as cost of the proceedings. Order shall be complied within one month from the date of order failing which the whole amount shall carry interest @ 9% p.a from the date of order till realisation. Complainant is directed to return the computer to the opposite party on receipt of the ordered amount.
