J U D G M E N T:
The case of the petitioner, in brief, is that on 8-10-2011the petitioner purchased
a 'Star Bus' from Kiran Transport Company Pvt.Ltd., Guwahati at Rs.13,64,000/-
taking loan of Rs.10,88,030/- from UnitedBank of India, Dhemaji Branch. But,
the vehicle was defective. After one month from the date of purchase, the vehicle
became unserviceable due to mechanical defect. The vehicle was repaired in many
times at HimatsingkaAuto Enterprises, Bandardewa. The vehicle was lying in the
workshop from 19-12-2011 to 19-1-2012. Again, it was lying in the workshop of
Himatsingka Auto Enterprises from 31-1-2012 to 11-2-2012. Till now, the vehicle
is in unserviceable condition. The petitioner has to bear a huge cost and he is
unable to repay the bank loan. He wants to return the vehicle to Kiran Transport Co./TATA Motors.
According to the petitioner, Kiran Transport Co. Pvt. Ltd. as well as Tata Motors Ltd.
are liable to pay the cost of the vehicle. Hence, he has prayed to direct the opp.
Parties to pay him an amount of Rs.13,64,000/- i.e. cost of the vehicle.
Notice was served upon the opposite parties. But, they did not like to contest the case
by filing written statement. Hence, the case proceeded ex-parte.
In course of ex-parte hearing, the petitioner and one other witness namely-
Indra Kamal Dutta submitted their evidence on affidavit as PW1 and PW2.
I have heard learned Counsel on behalf of the petitioner. Perused the pleadings,
evidence and documents (photo copy) submitted by the petitioner in support of his claim.
It is seen that on 8-10-2011, the petitioner purchased a Tata Star Bus from
Kiran Transport Co. Pvt. Ltd., Guwahati. The price of the vehicle was Rs. 12,78,706.00
including vat. As per terms and conditions(No.8) of the Tax Invoice, only the courts of
Guwahati shall have jurisdiction in any proceedings relating to the contract. But, the
petitioner has filed this case before this Forum at Dhemaji. So, this Forum has no jurisdiction
to decide the case.
Considering this aspect, the case is dismissed.
