1. Complainant is aggrieved that the Vaccum Cleaner purchased on 10-2-2008 from opposite party at the 'Parppidam Exhibition Stall' conducted by opposite party at Kottakkal which is within the jurisdiction of this Forum became defective in August, 2008. Though he sent registered notice to opposite party requesting for repair and replacement opposite party did not heed to his grievance. Hence this complaint.
2. Notice issued to opposite party was served. Neither did opposite party appear nor did opposite party file any version. Opposite party was set exparte on 27-2-2009.
3. Complainant filed affidavit reiterating the averments in complaint. Ext.A1 is the bill issued by opposite party to complainant for Rs.2,650/-. Ext.A2 warranty card shows that the product is offered two years warranty. There is no contra evidence adduced on the side of opposite party. Complainant has established a case in his favour. In the result we allow the complaint and order opposite party to refund the amount of Rs.2,650/- )Rupees Two thousand six hundred and fifty only) to the complainant along with cost of Rs.2,000/- (Rupees Two thousand only) within one month from the date of receipt of copy of this order. On payment complainant shall return the defect alleged product to opposite party if not returned earlier.
