This is a complaint filed under section 35 of Consumer Protection Act 2019 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:
This is a complaint filed by the complainant against the opposite party alleging deficiency in service. After admitting the complaint notice was issued to the opposite party. After accepting the notice the opposite party failed to appear before this Commission on the date fixed for the appearance of opposite party. Hence on 30/11/2021 opposite party was set ex parte and posted for the purpose of filing affidavit of the complainant. As the complainant was continuously absent a notice was issued to complainant to appear before this Commission today for filing proof affidavit. After accepting the notice the complainant failed to appear before this Commission on this day. In the above circumstances we find that the complaint is not interested to further proceed with this complaint.
In the result complaint is dismissed for default. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
