  1. The instant case was filed by complainant U/S 12 of the C.P. Act, 1986 wherein the complainant has  prayed for direction upon the o.p. to deliver the accessories of the motor bike and to pay compensation to the tune of Rs. 20,000/- and Rs. 50,000/- as litigation costs as the o.p. in spite of receiving full payment of Rs. 52,731/- for sale of the Bajaj Brand motor bike on 05-02-2014 did not supply the accessories namely leg care, sari guard and mirror. 

 

  1. In the written version the o.p. contended interalia that those articles were not deliberately provided to the  complainant;  that the complainant did not make any contact for receiving the same. So the complaint should be dismissed.  

 

3.        Upon pleadings of both parties two points arose for determination :

 

i)          Is there any deficiency in service on the part of the O.P.  ?

  1. Whether the complainant is  entitled to get any relief as prayed for ? 

 

 

 

 

DECISION  WITH   REASONS      :

 

 

  1. Both the points are  taken up together for consideration. Admittedly the complainant purchased a motor cycle of Bajaj made in the brand name ‘Discover Loot’ on 05-02-2014 from the o.p. Vedant Automotives Pvt. Ltd. at a total cost of Rs. 52,731/-. But at the time of delivery the o.p. did not supply the leg guard, saree guard and rear view mirror. The challan issued by the o.p. endorsed  ‘due’. On several visits to the o.p. shop, the o.p. did not deliver those accessories. 

 

  1. On scrutiny of the papers and as per submission of the ld. Lawyer for the o.p it is clear that the three items as above are yet to be supplied.  Therefore, we are of the views that this is a fit case where the prayer of the complainant shall be allowed. Both the points are accordingly disposed of.          

 

      Hence,

                       

O     R     D      E      R      E        D

           

 

      That the C. C. Case No. 113 of 2014 ( HDF 113 of 2014 )  be and the same is  allowed on contest with  costs as  against  the O.P. 

 

      The O.P. be directed to deliver the three items viz. leg guard, saree guard and mirror to the complainant within 15 days from the date of this order

     

      The o.p. be further directed to pay a sum of Rs. 5,000/- to the complainant as compensation for causing unnecessary  harassment and mental pain together with Rs. 3,000/- as litigation costs within the period as mentioned above.

 

      The complainant is  at liberty to put the decree into execution after expiry of the appeal period.

       

      Supply the copies of the order to the parties, as per rule.
