SRI.JIMMY KORAH (PRESIDENT

Complainant is the nominee of her father Satheesh Kumar in an insurance policy. The policy covers death due to accident. Her father died in an accident and she preferred a claim from the opposite parties. But they not honored the claim. Hence she filed this complaint.

1. Notice was issued to opposite parties and the same was accepted by them. But not appeared before this Forum. Hence opposite parties set exparte.

2. Considering the contention of complainant this Forum framed the following issues.

Whether there is any deficiency of service on the part of the opposite party?

Complainant filed proof affidavit and produced 6 documents which are marked as Ext A1 to A6.  From Ext A1, it can be seen that her father taken a policy for covering the accidental death and sum assured is Rs.1,50,000/- (Rupees one lac fifty thousand only). Ext. A2 shows that the said Satheesh Kumar died in a road traffic accident. Police registered a crime as Crime No.234/2008 of Punnappra Police Station. Ext. A3 is the post mortem report shows that death was caused due to accident and it consequence. Ext. A1 is the policy copy shows that complainant is the nominee of the insured. Hence she is entitled to get insured amount. Hence complainant is entitled to get Rs.1,50,000/- (Rupees one lac fifty thousand only) with 9% interest from 22.7.2010. Complainant is entitled to get cost of Rs.1,000/- (Rupees one thousand only). Complaint allowed.
