   The case of the complainant is that the  opposite party is not returning his  title deed and documents even after repaying entire loan amount with interests accrued there on.

2.    According to opposite party the complainant had repaid the entire loan amount.  But the complainant has not utilized the housing  loan for constructing the house though loan is provided for house construction.  Therefore  criminal action is instituted against the complainant and complainant repaid the amount because of criminal action and not voluntarily .  The opposite party has sought permission to return the title deed of the property of the complainant from  the higher authorities.

2.    Heard both sides.  The learned counsel for opposite party submitted that the documents can be returned as getting permission from the higher authorities of opposite party.  But the learned counsel for complainant submitted that the complainant is in due  need of the document.

 

 

 

 

               In view of the above submission of  respective counsel we pass the following order.

  The opposite party is directed to   return  all the title deed and documents pertaining to the property of the complainant  which he deposited for availing the loan within 30 days from the date of receipt of copy of this order.  Failing which opposite party shall further liable to pay a sum of   `5000/- as compensation to the complainant.  No order as to costs.
