Sh. Rajeev Muyal, Advocate, holding brief of Sh. T.S. Bindra, learned counsel for respondent No. 1 is present. None is present on behalf of respondent No. 2.
No adjournment application has also been moved on behalf of the appellant.
Perusal of record reveals that none was also present on behalf of the appellant on the previous date, i.e., 14.03.2023, on which date, following order was passed by this Commission:
“Case is called out.
None is present on behalf of the appellant.
Vide order dated 11.10.2022, office was directed to issue court notice to the appellant, as none was present on behalf of the appellant on the said date too.
According to office report dated 14.03.2023, registered court notice was issued to the appellant on 21.10.2022, which is received back in the office with postal endorsement that the appellant is not traceable on the given address inspite of sufficient efforts.
Further, according to office report dated 14.03.2023, registered court notice was issued to the appellant on the same address, which was mentioned in the memo of appeal.
However, in the interest of justice, one more opportunity is provided to the appellant.
Put up on 28.03.2023 for hearing.”
Inspite of that, none has appeared on behalf of the appellant even today.
It appears that the appellant is not interested in pursuing the appeal.
Accordingly, the appeal is dismissed in default of the appellant.
Let the record be consigned.
