for the respondent did not appear on the date fixed, we directed the office to send notices for 03.2.2009 to M/s Koura & Co. as well as to the respondents.  Counsel for the respondents did not  appear on 03.2.2009.  The case was adjourned to 05.5.2009.  On that date,              Ms. Shobha, counsel for the petitioner was not present.                         Mr. Mohinder Thakur appeared on her behalf and prayed for an adjournment which was refused as the revision petition was of the year 2000.  Paper book was handed over to Mr. Mohinder Thakur to enable him to go through the same but he refused to argue the matter as he had no instructions to do so.  The petition was dismissed for non-prosecution.

An application for restoration of the revision petition was filed which came up for hearing on 29.5.2009.  For the reasons stated in the application, revision petition was restored subject to payment of Rs.10,000/- as cost with Consumer Legal Aid Account, failing which the revision petition was to be dismissed without any further reference.  The case was ordered to be listed for today for final hearing.

Ms. Shobha, counsel for the petitioner states that she had addressed a letter to the petitioner to come and deposit the cost but the same has been retuned back to her.

Order dtd. 29.5.2009 has not been complied with.  Revision petition is dismissed for non-prosecution.
