       No step is taken by the parties. Record shows that OP No.1 was  directed to file W/V and the Complainant was directed to take fresh steps for issuance of notice upon OP No.2. But the parties  have  not been taking steps for long period.     

     The case of the Complainant in short is that the Complainant has a savings account bearing S/B A/C  No. 911010009132537 at Axis Bank Ltd, Rampurhat Branch, Dist-Birbhum. On 05.01.19  at about 6.15 pm.  the Complainant went to the Panchgram 18 No. SBI ATM to withdraw cash of Rs. 20,000/-. At first the Complainant withdrew Rs. 10,000/- which he received but second time when he want to withdraw Rs. 10,000/-, the ATM machine was about to dispense the cash, the electricity went off and the cash of Rs. 10,000/- was not dispensed from the ATM machine but the amount was deducted from the account of the Complainant. On 06.01.19 the Complainant lodged a complaint to OP No.2 to look into the matter but in vein. After waiting for about twelve days the Complainant again lodged another complaint to the OP No.2. On 14.02.19 he further lodged a complaint to the OP No.1. But OPs did not look into the matters.

           We peruse the materials on record. We find that the Complainant took no step on 07.04.20, 07.07.20, 21.08.20, 25.01.21, 16.04.21, 27.08.21, 30.12.21, 14.03.22, 20.04.22, 03.11.22, 24.01.23 and today i.e. 10.05.23. Moreover, considering the facts and circumstances of the case we are of the view that the instant case has no merit as the Complainant is not at all interested in the case.

        In view of the matters discussed above we are of the view that the instant case is liable to be dismissed on merit.

 

    In the result, the instant case fails.

    Fees paid are correct. Hence, it is

                                              Ordered

that the instant case bearing No. CC/156/2019 be and the same is dismissed on merit without cost against the OPs.

Let plain copy of this order  be supplied free of cost, to each of the parties / Ld. Advocate/Agent on record, by hand /by post under proper acknowledgment  as per rules, for information and necessary action.
