This complaint coming up for hearing on admission the Forum doth order as under:

 


 

ORDER


 


 

The complainant is aggrieved that opposite party Bank refused to sanction loan of Rs.1,50,000/- even though he submittednecessary documents and processing fees. Heard the complainant in detail. In a catena of cases it is decided by the Apex Commission that refusalto sanction loan will not amount to deficiency in service. It is held in 2004 CTJ 35(CP) NCDRC Velappan nair Manager, Kerala state Co-operative Bank and anor. Vs. K.P. Suran that 'sanctioning of loan is within the discretion of a bank and a borrower cannot have any vested right of being sanctioned of the entire loan applied by him'.

For these reasons we hold that there is no prima facie deficiency in service, and that complaint is not maintainable. Hence dismissed.
