This complaint coming up before us for hearing on admission on the question of territorial jurisdiction this Forum doth order as under:

ORDER

The address of opposite party shown in the cause title of the complaint is not within the territorial limits of this Forum. It was submitted on behalf of complainant that one Noorudheen, who is a sales executive of opposite party came to the complainant's shop at Edavanna, Malappuram District and canvassed booking of Ford vehicle. That complainant initially paid Rs.5,000/- as advance vide cheque from Edavanna. Later while changing the booking complainant paid Rs.45,000/- vide cheque

of State Bank of India, Kozhikkode branch from Edavanna. It is contended that since the cheques were issued to opposite party through the sales executive at Edavanna this Forum has jurisdiction to try the complaint we are not inclined to accept this contention. Opposite party is having office and is conducting business at Kozhikkode which is adjacent to this district. In our view the place from where cheque was handed over would not confer jurisdiction to this Forum to entertain this complaint. Hence we dismiss the complaint with liberty to the complainant to file the same before competent Forum. We make no order as to costs.
