Complainant is found absent on call. The record shows that the Complainant has already withdrawn the cheque in question. The complainant filed a petition on 27.08.24 praying for dismissal of the case on the ground that he is not willing to proceed with the case as he has already received the cheque for his remedy. Such being the position, the instant case is required to be dismissed for non-proseuction.

Hence, it is

that the instant complaint bearing no. CC/190/2019 be and the same is dismissed for non-prosecution.
