Final Order / Judgement

        The case of the complainant is that he has joined in the Pearls project conducted by the opposite parties by depositing Rs.10,200/- for 7 years on 30/04/07. The deposit was accepted by the opposite parties and a Receipt cum Acceptance letter served to the complainant. As per the scheme complainant has to get Rs.20,807/- on 30/04/2014. Whereas even after repeated demands made by the complainant the opposite parties has not returned any amount to the complainant. At last on 15/02/2016 complainant finally demanded the amount from the opposite parties. By accepting deposited amount from complainant and by not providing the maturity benefit to the complainant the opposite parties committed deficiency in service as well as unfair trade practice towards the complainant. Hence this complaint is filed for getting relief.

        2) On receiving complaint, notice was properly issued to all the opposite parties. Whereas, the opposite parties neither appeared before the Forum nor submitted any version. Hence, all the opposite parties set ex-parte and posted for complainant’s evidence. From the side of complainant he has appeared before the Forum and submitted proof affidavit in which he has affirmed and explained all the averments stated in the complaint in detail. He also produced one document which is the copy of Receipt cum Acceptance letter  and marked as Ext. P1. Since there is no contra evidence available, we are inclined to accept the proof affidavit filed by the complainant. Ext. P1 would go to show that the complainant has deposited Rs.10,000/- towards C3 Plan of the opposite parties on 30/04/14. It also would go to show that an estimated realizable value at end of the term is Rs.20,807/- the expiry date is also shown as 30/04/14. Considering all these points we are of the opinion that by denying maturity value the opposite parties committed deficiency in service towards the complainant.

        In the result, we allow this complaint and the opposite parties are directed to pay Rs.20,807/- (Rupees Twenty thousand eight hundred and seven only) with 12% interest from the date of complaint to the complainant within one month from receiving copy of this order. Failing which the complainant is entitled to get 12% interest till realization.
