 The concise fact of the case  of the complainant  in a nutshell  is that complainant Goutam Sarkar was told  by the OPs, Manager, Sahara India Credit company post office Krishnagar  P.S. Kotwali with an assurance  that if an investment  is made he would  get good return  on maturity . So, the complainant  deposited  Rs.3,31,154/- on different dates  with the  OP No.2 Sahara Credit Co-operative Society Limited, OP No.11 Manager of OP No.2 company. The OP No.1 collected  the entire money  and deposited  on behalf of the complainant and issued receipt  and certificate . Subsequently,  on 22.07.2019 the complainant  went to the  office of the OP No.1 to submit  all documents  but the OP No.1 did not take  the documents and asked  him to reinvest  the said money. The complainant  requested to  the OPs to return the  deposit  money but the  OPs  failed to  return the  said money after  maturity , so  the OP has committed gross negligence  in which the complainant suffered financial loss and  has been harassed. The complainant , therefore,  prayed  for an award  against the  OPs  for Rs.4,35,907/- against the  certificates issued by the OPs  together  with interest  @12% p.a, Rs.40,000/- towards  financial loss and Rs.20,000/- towards litigation cost.

After perusing the case record it appears  that notice was served upon the OP No.1&2. Despite  service of notice both the OPs failed to appear in this case. Accordingly,  the case is decided to be heard ex-parte  against both the OPs.

The complainant  in order to  substantiate  the case adduced  oral evidence  in the form  of affidavit in chief  and documentary  evidence.

The complainant  proved the original service of investment with the  OP No.2 Sahara Credit Cooperative  Society Limited Company.  The complainant  proved 17 certificates  of investment  of money to the tune  of Rs.3,31,154/-. The said investment  certificate  was duly  signed  by the authorised  signatory  of OP investment company.

The entire oral and documentary evidence  of the complainant  stands unchallenged  and undiscarded  in as much as  the OPs  could not rebut it.

The complainant  categorically  stated that despite  investment  of the said  money the OP did not refund  the maturity  money  to the complainant.

Thus having assessed  the unchallenged  and undiscarded  oral and documentary  evidence  of the complainant  the Commission comes to the finding that the complainant successfully proved the  case  against the  OPs upto the hilt.

The aforesaid  misdeeds  on the part of the OPs by  not refunding the maturity money  despite  investment  of huge  money  tantamount deficiency in service which caused  mental pain and agony to the complainant and as such  it should be compensated  in terms of money.

 

In the backdrop of the aforesaid  discussion  and observation  made hereinabove the Commission  comes to the finding that the complainant  is entitled to get the relief  prayed for.

Consequently,  the complaint  case succeeds ex-parte against the OPs with cost.

Hence,

Ordered

that the complaint case no.CC/302/2019 be and the same is allowed ex-parte against the OP No.1&2 with cost of Rs.20,000/- (Rupees twenty thousand). The complainant Goutam Sarkar do get an award against the OP NO.1&2, Manager Sahara India and the Director  Saahara Credit Co-operative Society Limited  for a sum of Rs.4,35,907/- (Rupees four lakh thirty five thousands nine hundred seven) together  with interest  @12% p.a from the date of maturity  till the date of payment and Rs.40,000/- (Rupees forty thousand) towards  financial loss.  The OPs are directed  to pay Rs.4,95,907/- (Rupees four lakh ninety five thousand nine hundred seven) within 30 days from the date of passing the final order  failing which  the entire award money shall carry an interest @12 p.a  from the date of final order till the date of its realisation.

All Interim Applications  (I.A) stand disposed of  accordingly.

Let a copy of this final order be supplied to both the parties at free of costs.
