The complainant has filed this case with prayer to direct the Chief Manager, State Bank of India Angul branch(opp.party ) to release the stolen cash of Rs. 12,000.00 with admissible interest from the date of theft i.e from 23.9.2011 to till the release of the said cash with compensation of Rs. 4,000.00 towards mental agony and litigation charges.
2. The case of the complainant is that he had savings bank A/C No. 11083174865 with the opp.party and he was operating ATM Card No. 6220180000700171275 and drawing his pension through the ATM Card. On 23.9.2011 at 7.33AM he went to State Bank of India main branch and drew Rs.1,000.00 through the ATM, leaving remaining balance Rs. 12,257 .00 in his aforesaid S.B A/C. It is alleged that on 28.9.11 when he used the ATM Card found only Rs. 257.00 was in his S.B A/c. and rest Rs. 12,000.00 was stolen. So he reported the fact to the IIC,Angul who registered P.S Case No. 696 dt. 17.12.2011 U/s. 379 I.P.C and continued his investigation but in vain. So the complainant has filed this case.
3. The opp.party has contested the case by filing written version, stating that due to negligence of the complainant the cash was stolen and they have no contribution in it, for which they have prayed for dismissal of the case.
4. During course of argument both the counsels have filed a memo stating that “ Both the parties amicably agreed to settle the dispute in terms of money to the tune of Rs. 20,000.00 and accordingly necessary order may be passed for payment of the settled amount”.
5. In view of the above settlement by both the learned counsels the following order is passed.
: O R D E R :
The opp.party i.e Chief Manager,State Bank of India,Angul Branch is directed to pay Rs. 20,000.00 (Rupees Twenty Thousand) to the complainant towards theft of cash, cost of litigation and mental agony suffered by him within 15(fifteen) days of this order.
