Today is fixed for admission hearing. Ld. Advocate for the complainant is present. On perusal, it appears,  the specific case of the petitioner is that he took credit card from the Op  in the year 2014, in 2019, someone called him to let him know that he has Loan liabilities to the Op by virtue of the Credit card by the name of SBI Credit card Ltd. After that he checked the Cibil score and found that the score is much below to the normal rate.The agent of the Op called the petitioner and made him aware about the Credit card liabilities by the virtue of SBI Credit Cards in 2020. It has been submitted by the petitioner in the complaint petition that he had never used/applied for the Credit card after the year 2018.

It seems to us that no specific amount is mentioned by the petitioner regarding the Credit card liabilities. Moreover, it is mentioned in the complaint petition that photocopy of the cibil score is enclosed with the complaint petition; but there is no such document has been annexed with the instant complaint petition. The petitioner furnished the photocopy of SMS of the Op in which there is a request to clear outstanding of Rs.4214.04/- on his card ending 4303 to improve credit scores. But, there is no documents whether the petitioner replied the said SMS or lodged any complaint to the Op. It is also not specified by the petitioner that whether he took any loan from the Op by using the said Credit card before 2018. Therefore, we are of the opinion, that the complainant failed to establish the cause of action as well as the complaint.

Due to lack of proper document, the complaint case is not admissible and it is not admitted.
