Today is fixed for hearing of this M.A. case which has been initiated by the complainant of C.C. no. 168 of 2022 for rejecting the W/V which has been filed by the op.

From the case record of C.C. 168 of 2022 it is reflected that the op received the documents which are annexed with the complaint petition in the month of October and thereafter W/V has been filed in the month of November.

It is also revealed that due to delayed supply of the documents to the op of the above noted C.C. case, the delay has  been caused by the matter of filing W/V but facts remain that the said delay of the op is not intentional delay.

Considering this aspect this District Commission is of the view that there is no scope to reject the W/V particularly when the case is ready for starting trial.

Under this position the M.A. no. 23 of 2023 is rejected on contest.

Let this case record be tagged with the C.C. no. 168 of 2022.

In the light of the observation made above the M.A. no. 23 of 2023 is disposed of.
