                                                      ORDER

   Laxmanan, the complainant availed a loan of Rs.1,00,000/- from the opposite party with a condition to repay Rs.1,30,500/- in 30 monthly instalments.  He hypothecated the R.C book of his vehicle KL-14/46138 for the loan.  He repaid the  entire amount, though not regular in monthly  instalment payments.  But the opposite

 Party refused to return the R.C. book and H.P. termination letter  with  no objection certificate to cancel the endorsement from the RC and to assign the vehicle and claimed a sum of Rs.50,000/- in addition to the payments already  received.  Hence the complaint.

2.   Though notice is sent to opposite party by registered post, it was returned unclaimed .  Hence opposite party set exparte.

3.   Complainant filed affidavit in support of his claim.  Exts.A1 to A5  marked.

4.   According to complainant he paid Rs.131100/- instead of the stipulation to pay Rs.130500/-.  But the opposite party is  not given back the original R,C along with H.P. termination letter and   No objection certificate .   The non return of the deposited documents even after closing the loan amounts to deficiency in service.

        Therefore the complaint is allowed  and Opposite  Party is directed to return the original R.C of the vehicle bearing Reg. No.KL-14/A6138 along with H.P. Termination Letter and No Objection Certificate to the complainant within 30 days from the date of receipt of copy of order, failing which on request of the complainant direction will be given to the concerned Registering Authority to issue duplicate R.C after canceling the H.P. endorsement.  Opposite party also directed to pay Rs.5000/-  as compensation  and Rs.2000/- as costs to the complainant.
