Today is fixed for hearing of petition filed by the OP No. 2 dated 22/03/2023. Both parties file haziras through their respective Ld. Advocates. Heard Ld. Advocates for both sides.

One petition has been filed by the OP No. 2. Same has been registered as M.A. Case being No. 43/2023. Record is now taken up for hearing.

Perused the petition. Considered. From the content of the petition it appears that OP No. 2 prays for expunge the name of the OP No. 2 i.e. Magma Finance Corporation Ltd. from the cause title of this case. It is the submission of Ld. Advocate for OP No. 2 that the complainant filed this case against OP No. 1 and the complainant has no grievance or claim against OP No. 2. We are only necessary party with this case. Thus OP No. 2 prays for expunge their name from the cause title of this case. No objection raised by the complainant.

Hence, it is,

                        ORDERED,

                                                the petition dated 22/03/2023 filed by the OP No. 2 for expunge their name from the cause title of this case i.e. M.A. Case No. 43/2023 is allowed without contest. No cost.

Thus the M.A. Case No. 43/2023 is disposed of.

Fix.  04/10/2023 for argument and filing W/N/A 2 days ahead.
