JUDGMENT

  1. The present complaint has been filed by the complainant before this commission for  payment of assured sum Rs. 300000/( Three Lacs)

  

  1. The Complainant stated that her son had obtained Jeewan Anand Policy from OP who died on 14.10.2014 having fallen suddenly. On 26.03.2016 claim was repudiated on the ground of suicide within in year taking the policy.
  2.  Op submitted in WS that the deceased policy holder committed suicide within claiming month from the date of issue of the policy and no F.I.R. Panchnama etc proved that the policy holder had died in accident as submitted by the complainant.
  3. Complainants have filed his affidavit and papers  in support of his pleadings.  Op has also filed his affidavit and papers  in support of his pleadings
  4. We have perused the material available on record and heard the parties counsel.
  5. The first question of consideration before us is whether the complainant are entitled to any relief?
  6. It is evident from the postmartum Report that the cause of death of the deceased policy holder was aspsbysia as a result of hanging and thus it is evident that he has committed suicide. Thus  the claim was rightly repudiated and there is no entitlement of assured amount.
  7.   The question formulated  is decided against  the complainant .
  8.  We hereby dismissed the Complaint.
  9. A copy of this judgment be provided to all the parties as per rule as mandated by Consumer Protection Act, 2019. The judgment be uploaded forthwith on the website of the commission for the perusal of the parties.

File be consigned to record room along with a copy of this judgment
