Baijanti Devi filed a consumer case on 17 Aug 2024 against Manager, L.I.C Jehanabad in the Jehanabad Consumer Court. The case no is CC/28/2021 and the judgment uploaded on 28 Aug 2024.

Learned advocate for the parties have already been heard. Present consumer complaint under section 35 of the Consumer Protection Act has been filed on 16.06.2021 against the OP alleging deficiency in service through non payment of the due premiums even before the policy could have acquired paid up value on the date of death of the insured proposed.
Case of the complainant in nutshell is that the complainants husband has taken a life insurance policy while policy no-817184862 upon which the risk commenced on 27.09.2017 likely to mature on 27.02.2038. According to the complainant she regularily used to handover the premium to the agent of the OP but the said agent deposited a single premium only in the office of the OP and after the keeping them in dark the agent misappropriated all the paid premiums amount only on the date of death of the insure after having knowledge of death of the life insured he went to the office and credited the due premiums and further interpeleted the time of death of the policy holder from 11:00AM to 7:00PM in the certificate of the doctor cartyfying the death and when the policy holder’s wife Baijanti Devi complainant here stack her claim for the assured amount before the OP the same was repudiated vide OP letter dated 01.01.2021 holding that the polciy was not inforce at the time of death life assured. Since, the premium was paid up to december 2017 only and the death occured on 15.09.2018 as such the risk was not covered under the policy on the date of death of policy holder further since the policy was not paid up to three years even the policy has not accquired the paid up value on the date of death through the above referred letter OP informed that they are refunding the premiums paid after death of the life assured.
Case of the OP is as per the letter dated 01.01.2021 and nothing else same has been reiterated in the Show cause of the OP alongwith the letters referred and the premium receipt etc.
From the facts apparent on the record through the documents like premium receipts and the repudiation letter dated 01.01.2021 itself it is cystal clear that the premiums have not been paid even up to three years to attain paid up value unacceptable amount of premium deposited with the OP after death of the policy holder has already been refunded. As such, I do not fined any kind of deficiency from the part of the OP.
Hence, the present complaint being devoid of any factual or statutory merit is dismissed.
