           This is a complaint filed under Section 35 of the Consumer Protection Act, 2019.

2.  The case of the complainant, in brief, is as follows:

On 23/06/2022 the complainant purchased cloth from the shop of the opposite party paying  Rs. 3,533/-. But after stitching churidar with the cloth and using once, it tore and became damaged and thus unsuitable for wearing.  On 17/07/2022 the complainant approached the opposite party and demanded new cloth. But the opposite party insisted for the bill. On 18/09/2022 the complainant again approached the opposite party with the bill. But the opposite party was not ready to replace the damaged cloth with new cloth, stating delay. Hence the complaint for compensation of Rs. 10,000/-.

3.    Though the opposite party appeared before this Commission, he failed to file version. He was set ex-parte.  

4.  The points that arise for determination in this complaint are :

1. Whether the cloth sold to the complainant was defective, as alleged?
2. Whether there was any unfair trade practice or deficiency of service on the part of the opposite party?
3. Reliefs and costs.

5.       The complainant was examined as PW1 and  Ext A1  was marked.
6.        Heard.

7.     Points 1 and 2 – The complainant has approached this Commission seeking compensation of Rs. 10,000/- alleging that the cloth sold to him by the opposite party was defective and there was neglect on the part of the opposite party to redress his grievance. The specific allegation is that the opposite party refused to replace the defective cloth with new cloth.

8.     PW1, who is the complainant, has filed proof affidavit in terms of the averments in the complaint and in support of the claim. Ext A1 is the bill dated 23/06/2022 for having purchased cloth worth Rs. 3,533/-  from the shop of the opposite party. PW1 has asserted and reiterated that the cloth was defective and not suitable for wearing and there was neglect on the part of the opposite party to redress his grievance in spite of approaching him with the bill as directed by him.  The evidence of  PW1 stands unchallenged. The opposite party has not produced any evidence to disprove the averments in the complaint  or to rebut the veracity of the documents produced and marked on the side of the complainant. The case of the complainant stands proved through the testimony  of PW1 and Ext A1 document. The act of the opposite party amounts to unfair trade practice and deficiency of service. The complainant is entitled to get refund of the price of the cloth amounting to Rs. 3,533/-. He is also entitled to get Rs. 1,500/- as compensation for the mental agony and hardship suffered.

9. Point No.3 :  In the light of the finding on the above points, the complaint is disposed of as follows: 

1. CC 247/2022 is allowed in part.
2. The opposite party  is  hereby directed to refund Rs. 3,533/-  (Rupees

three thousand five hundred and thirty three only) to the

complainant, being the price of the cloth.

3. The opposite party is directed to pay a sum of Rs.1,500/- (Rupees one 

thousand five hundred only) as compensation to the complainant for the mental agony and hardship suffered.

4.  The order shall be complied with within 30 days of the receipt of

copy of this order.

5. No order as to costs.
