Final Order / Judgement

Complainant files hajira through Ld. Lawyer.  Sri Prem Kumar Sarkar is present for OPs 1 & 2.  Sri Sarkar files a petition stating that he has given service as per direction of this Forum with prayer to relieve him from this case.  He submits that he has handed over the mobile phone in question to the complainant after repair.  Complainant at this stage, files a petition stating that he has received his mobile phone in OK condition from Prem Kumar Sarkar and he has no allegation against him.  The complainant has prayed for permission to withdraw the case.  Heard submission of the Ld. Lawyer for the complainant.   He submits that the matter has been amicably settled between the parties and the OP i.e., Prem Kumar Sarkar and that the representative of the OPs i.e. Prem Kumar Sarkar has handed over the mobile phone to the complainant after repair in OK condition and as such the complainant is not willing to proceed further with this case.  He prays for passing necessary order.  In view of above submission and the representative of the OPs and the Ld. Lawyer for the complainant and the petition filed today by the complainant we find that the matter and the case has been amicably settled between the parties and for this the complainant is not willing to proceed further with this case.  Hence, the case deserves dismissal. 

Hence, it is

ordered,

that the case is dismissed for non prosecution but without cost. 

            Let a plain copy of the order be supplied free of cost to the parties forthwith.
