JUDGMENT
Complainant has filed the consumer complaint U/s.35 of Consumer Protection Act, 2019 seeking compensation of Rs.17,000/- alleging that the complainant being an unemployed person availed a loan against one motorcycle being financed by opposite parties in the year 2020 for his livelihood and maintenance of his family by carrying/marketing fruits and vegetables. The complainant used the said vehicle for marketing and get his income to maintain his family and repay his loan. On 28.10.2022 opposite parties seized the vehicle along with one quintal of vegetables from complainant and used slag language to the complainant, which complainant protested. The opposite parties told that after repayment of all dues your vehicle shall be released along with vegetables within no times. On 29.10.2022 after payment of all dues the opposite parties have not delivered the said vehicle and played hide and seek with the complainant.
It is stated by opposite parties that complainant was in default for which opposite parties repossessed the vehicle on 29.10.2022. On being noticed the complainant on 20.10.2022 approached for OTS of his loan account No.33582841 and his letter No.SET-12478373 dt.29.10.2022 was approved and accordingly the complainant deposited Rs.10,000/- on 29.10.2022, which the complainant has suppressed in the consumer complaint and the loan account is already closed.
Therefore we find no deficiency in service or unfair trade practice on the part of opposite parties and accordingly the consumer complaint is dismissed. But in case the NOC has not supplied to complainant the same may be supplied to complainant within 45 days from the date of receipt of the order. No cost.
