ORDER

Attendance on behalf of the complainant filed through his advocate. OP absent. This record has been received from the mediation centre after settlement of dispute on payment of sum of Rs. 50,000/- to the complainant subject to the condition that complainant returns his defective machinery of floor mill purchased from the OP. Learned advocate for the complainant has produced the original copy of the consignment note by which the complainant has sent the goods in question to the OP through the transporter  OM logistics limited. Learned advocate for the complainant has submitted that in view of the settlement of dispute between the parties the cheque worth rupees 50,000/- sent by the OP and lieing on the record may be handed over to him as the complainant has already returned the goods in question to the OP as per the terms of settlement at the mediation centre.

In view of the above said facts and circumstances of  the case, let the cheque dated 14.09.2023 of ICICI Bank drawn in favour of the complainant be handcd over to the complainant on his identification and verification by his learned advocate.

Later on: Learned advocate for the complainant filed a petition to handover the cheque concerned to the complainant as per the terms of settlement at the mediation centre. Petition is allowed and office is directed to handover the cheque to the complainant on his identification by the learned advocate. After retaining photo state copy of the cheque as well as the consignment note filed the before this commission. Accordingly the complaint is disposed off in the light of settlement of dispute between the parties.
