ORDER BY HON’BLE PRESIDENT- MR. P.K. PADHI:

                                                                                                           JUDGMENT

            Complainant has filed the consumer complaint U/s.35 of Consumer Protection Act, 2019 seeking not to repossess TVS Apache Motorcycle bearing Regd. No.OD-02-H-6467 and to extend loan agreement period and waive out illegal charges and pay compensation of Rs.50,000/- towards mental agony and cost.

            Complainant took loan of Rs.73,850/- vide agreement No.ORCURMTW01147 on 30.9.2018 to repay in 36 monthly EMI @ Rs.2,866/-commencing from 05.11.2018 to 05.10.2021. Complainant failed to pay and violated the agreement for which on apprehension of repossession complainant has filed the consumer complaint seeking aforesaid relief. There is not a single scrap of paper from complainant asking opposite parties to extend loan agreement period for which we find no merit in the consumer complaint and any deficiency on the part of opposite parties. Besides that complainant is a defaulter of loan as per agreement.

            However taking a linnet view we dispose of the consumer complaint directing the opposite parties to consider the loan agreement period as desired by complainant opposite parties may charge the fees/additional interest to that effect. The complainant shall pay his regular EMI in each month towards pending EMI. For failure to pay regular EMI, the opposite parties are free to take action as per agreement rule/law. If the complainant pays the EMI regularly the opposite parties shall consider to deduct some ODI/Additional interest charge for failure to pay the earlier EMI in time. With the aforesaid observation and direction the consumer complaint is disposed of. No cost.
