Complaint relates to loan matter. Complainant availed loan amounting to Rs.25,40,000/- vide Loan Account No.81649760 from the OP-Finance Company, on execution of Loan-Cum- Hypothecation Agreement in the year, 2015, repayments with interest in 47 monthly installments from 03.10.2015 to 06.09.2019 @ monthly installment of Rs.67,750/- for Loan Account. The OP-Finance Company has stated in their written version that the complainant is a chronic defaulter of the installments and at present in LAN Ni.81649760 there is a huge outstanding towards EMI is Rs.5,42,000/- and total outstanding including the cheque bounce and late payment charges is Rs.6,04,066/- and against LAN No.81673433 the EMI outstanding is Rs.6,75,500/- and total outstanding including the late payment charges is Rs.7,60,861/- i.e. in to the total outstanding in both the loan is RS.13,64,972 as on 13^th March,2018. The main prayer of the Complainant i.e. for a direction to the OP not to repossess the finance vehicle has been complied in view of interim order passed earlier. Ehen both the parties had executed loan-cum-hypothecation agreement and agreed to abide by the terms and conditions of the same in case of default of in repayment OD interest has to be charged. But after perusal of the statement of account, in reveals that the OP-Finance Company has received the monthly installments except some months. The agreement/contract period has already been expired since 05.09.2019. As this Forum is not empowered to settle account between the parties. Accordingly the C.C. is disposed of.
