JUDGMENT
Complainant has filed the consumer complaint U/s.35 of Consumer Protection Act, 2019 seeking to realize the arrear EMI in easy installments.
Complainant took loan in 2020 to repay in 33 monthly EMI. Complainant failed to pay and violated the agreement for which proceeding U/s.138 of NI Act. has been initiated and on apprehension of repossession complainant has filed the consumer complaint seeking aforesaid relief. Relationship between complainant and opposite parties is that of Debtor and Creditor and complainant is liable to repay the loan as per the agreement/contract, for which we find no merit in the consumer complaint and any deficiency on the part of opposite parties. Besides that complainant is a defaulter of loan as per agreement.
Bank/financer is not at all to be bothered about any internal insight of complainant with his partner/tenant/friend who cheated him. Complainant has taken loan and he has to pay back the same with interest as per agreement and the period of agreement has already expired. So we find no merit in the consumer complaint and accordingly the consumer complaint is dismissed. No cost.
