Order No. 07 dated 03.02.16

      No Step is taken by the D.hr/complainant. The J.dr./OP No.1 Abbas Ali, owner of the Galaxy Shop is present personally by filing a petition along with V-nama .

     The J.dr./Op No.1 has surrendered before the Forum with a prayer for release on bail.

    The J.dr./OP no.1 has also filed a separate petition praying for a direction to deposit the awarded amount of Rs.2250/- as cost of the Mobile Set and compensation of Rs.1000/- and has also prayed for exemption of the cost for delay in payment of the awarded amount. 

     Heard the Ld. lawyer for the J.dr/Op no.1 and also perused the materials on record.

      Considering the material on record we decide that the J.dr/Op No.1 is to pay Rs.3000/- towards the cost for delay of payment which is to be deposited in the Consumer Legal Aid Account.

     We also consider the prayer for depositing the awarded amount of Rs.(2250 +1000/-) i.e. in total Rs.3250/- and the same is allowed.

    Sri Jogesh Ch. Biswas, Bench-Clerk is to receive Rs.3000/- as cost for delayed payment and Rs.3250/- as cost of the Mobile and compensation and keep the same in office custody for deposition in Consumer Legal Aid Account and for disbursement to the D.hr/complainant.

     Inform the D.hr/complainant at once.

     The disbursement of the awarded amount to the D.hr is subject to deposit of the Mobile Set along with its accessories.

     The Execution Application No.23/15 is thus disposed.

    Recall the Warrant of Arrest.

    Let a copy of this order be sent to the O/C, Domkal P.S. Murshidabad for recalling the W/A immediately and copy of this order be supplied to both parties free of cost.
