            The  complainant  has filed this  case  with prayer to  direct the  opp.parties  to  restore   power supply immediately to his  premises (Consumer No. K-I-0009), to  quash illegal  meter testing  report dtd. 29.9.2016 made by the opp.parties and to  quash  the illegal  demand of  electric rent  from April,2013  to till  finalization of the  case and  to pay  compensation as well as  cost of  litigation.

2.         The  complainant’s  case  runs thus :-

            That, he is  a  bonafied  consumer  under the opp.parties vide No. K-I- 0009 since  1987  and  regularly  paying  the rent. It is  alleged that the  connected  load of the  complainant  is  10 K.W  but the  opp.parties  demanded  high  arrear amount  claiming the   consumption  unit  to be  more than  10KW. According   to the   complainant, on 18.1.2015 the opp.parties  installed a   new  meter  on his  huller  after  due  test and the meter is  perfectly  running and  he is  paying   due  rent  regularly. but  without  any rhyme   or reason  the opp.parties  served  a  demand  notice for  Rs. 1,03,334.92  without   any  computation  sheet. Thereafter, the  complainant  met the opp.parties  time and  again and  requested  for  redressal of  his  complain but in  vain. It is  alleged  that, instead of  solving  the  problem  of the  complainant, on 7.10.2016 when  he   was  absent in  his  house, the opp.parties  arbitrarily  disconnected  the   power supply  .Hence  this  case.

3.         Though  the  opp.parties   did not file  written version  but have  contested  the  case.

4.         During   hearing the   learned  counsel for the opp.parties filed  a memo on 11.4.2018 stating that :-

         “On 3.11.2016 during   hearing of  Misc Case No. 28 of 2016  arising  out of this  case, there  was   understating  between  the opp.parties  and  the  petitioner  that  till that  date (3.11.2016)  petitioner/complainant  would pay Rs. 30,000.00  towards total  arrear and  accordingly  the petitioner  deposited Rs. 10,000.00 on 10.11.2016. The  rest Rs. 20,000.00 has been collected  by the opp.parties  along with  the  electric  bill  of December, 2016 and January, 2017  and  from December 2016  onwards  the  opp.parties  are collecting  monthly rent  as per actual  meter  reading”.

            With  the  above  statement the  counsel for the opp.party has  prayed for disposal of this  case  as compromise and  understanding. The  complainant’s  counsel  has no objection to  it. From  the  above  statement of the opp.parties   it is  clear that, besides  collecting  monthly rent  for December,2016 and January,2017, they have   also  taken  Rs. 20,000.00  in those two  months  towards  arrear upto 3.11.2016  as per  their  understanding.

5.         Hence  the  order :-

: O R D E R :

            The case  is disposed  of in presence of  both  the  parties. The opp.parties have  already  received the arrea of Rs. 30,000.00  upto  3.11.2016 , as such  they  will collect  the  electric  rent  from December,2016 as  per  actual  meter  reading. It  is  made  clear that Rs. 10,000.00  deposited  as  per  order  of Misc Case No. 28 of  2016 and  the  subsequent  collection of Rs. 20,000.00 along  with  electric  bill  of  December, 2016  and January, 2017  is  adjusted  towards  arrear demand of Rs. 30,000.00  till  3.11.2016.
