ORDER

            The petition was filed on12.11.2012. The case of the complainant is that complainant was a subscriber of a chitty of five lakhs, each chitty having a sala of 1 lakh. Against of the opposite party misleaded the complainant that Chitty is for 5 lakhs. First instalmet of the chitty  is Rs.12,500/- Opposite party offered at the time of joining the chitty that 5^th instalment the chitty would be disbursed after a deduction of 30%, means complainant is eligible to get Rs.3,50,000/-. Unfortunately complainant received only Rs.70,000/-. Now the opposite party violated the offer made by them. The act of the opposite party is clear deficiency of service. Therefore complainant is seeking relief against opposite party.

 

            Opposite party after serving notice not appeared or filed their version.

Points for consideration.

 

1)      Whether the  complaint is maintainable?

2)       Whether any deficiency of service on the part of opposite party.

 

Complainant  was continuously absent for the last 3 consecutive postings. On perusal of documents and the complaint itself not speaking the entire truth, complainant is failed to appear before this forum. Therefore on complainant itself no merit in this case. Therefore complaint is liable to be dismissed.
