Today the case is fixed for consideration on the maintainability of the present complaint.
Heard. On perusal of case file, we have observed that the complainant has purchased the bajra seed from the OPs on 20.6.2022 as per bill attached with the present complaint, sown the same in his three acres of land and poured the spray/medicine etc. to get good yield as per alleged assurance given by the OPs but despite best efforts of complainant, the complainant did not receive the desired yield and hence, he moved an application before Agriculture Officer, Bhiwani who inspected the crop and told that the seed was/is of inferior quality. It is averred in the complaint that due to supply of inferior quality of said bajra seed by the OPs, the complainant suffered losses to the extent of Rs. 1,00,000/-. Hence, filed the present complaint and submitted/requested this Commission to issue the notice against the OPs to decide the said complaint.
We have observed that the complainant has only placed on file the said bill of purchase dated 20.6.2022 and some coloured photographs of crop. But the complainant failed to place on record the alleged inspection report of Agriculture Officer, Bhiwani or any other congent and convincing evidence to satisfy this Commission in which manner, the OPs were at fault and why they should be summoned by issuing notice by this Commission.
Hence, prima-facie, we think that it is not a fit case for summoning of OPs by issuing notice by this Commission. Therefore, the complaint of complainant being not maintainable in the present form, deserves dismissal and hence, the same is hereby dismissed.
