JUDGMENT
Complainant has filed this consumer complaint U/s.35 of C.P. Act, 2019 seeking following reliefs;
“Direct the opposite parties to pay Rs.1,30,000/- to the complainant towards cost of his gold and pay Rs.1,00,000/- towards mental agony and suffering and Rs.20,000/- towards cost of litigation”.
Brief fact of complainant is that he availed gold loan of Rs.58,000/- by pledging gold of 27.76 gms on 02.11.2019. Due to Covid-19 he could not repay the loan and his gold has been auctioned on 04.4.2022 when he received the notice on 18.4.2022.
We have gone through the contention of both parties and found that notice to complainant was issued by opposite parties by Regd. Post on 16.3.2022 public notice was also published in local newspapers (Odia & English) on 13.3.2022 which the complainant has not disputed except a bald averment that he received the notice on 18.4.2022 i.e. after the auction, which has no leg to stand.
The opposite parties have auctioned the ornament for Rs.1,05,000/- and after keeping Rs.74,000/- credited Rs.31,000/- in the account of complainant. It is settled law that Consumer Commission cannot enter into the accounts arena for which we refrain from accounting with regard to price, profit/loss etc. and found no deficiency in service on the part of opposite parties. Hence the consumer complaint is dismissed. No cost.
