This is a complaint filed under section 35 of the Consumer Protection Act, 2019 alleging unfair trade practice and deficiency of service on the part of the opposite parties. The prayer is to direct the first opposite party to regularise the loan account and to slash the EMI to 48 total instalments and also to pay Rs. 1,00,000/- as compensation for the monetary loss and mental agony caused to the complainant
- The first opposite party has filed written version denying the allegations and claims made in the complaint. The second opposite party remained ex-parte.
- Today the case is posted for the affidavit of the complainant. But the complainant remained absent and there is no representation for her. The onus is on the complainant to prove the allegations. But the complainant failed to let in any evidence to prove the case so as to get an order as prayed for. The complainant is continuously absent and it appears that she is not interested in pursuing the matter. The allegations are not proved.
In the result, the complaint is dismissed. No order as to costs.
