ORDER

Both parties represented through their advocates. 

The present record is unnecessarily trailing for information about the amount of NCB by the OP which the OP wished to get deposited before making payment of the assured sum against the insurance policy of the insured vehicle in quotation. Despite repeated adjournments learned advocate for the OP has not been able to inform the amount of NCB expected to the deposited till date.

Today he has submitted that a direction may be passed by the commission to pay the admissible amount to the complainant after deduction the amount of NCB.

Learned advocate for the complainant has no objection to the above submission.

 In view of the above said facts and the admitted insurance of the vehicle  gone theft during the validity of the insurance coverage. The present complaint is allowed and the OP is directed to pay the assured amount as per the policy schedule within 60 days from the date of knowledge/ receipt of the copy of this order alongwith a sum of Rs. 5000/- for compensation for the mental agony physical suffered by the complainant cost of litigation, alongwith assured amount as per the policy schedule should be paid from the date of filing of this complaint with simple interest as rate of 6% per annum and otherwise the complainant shall be entitiled to recover the order amount as per the provisions of section 71 of the consumer protection Act from the OP.

Let a copy of this order be served to the parties in person or there authorised advocate free of cost.
