            Accordingly, the record is taken up for disposal.
 
            Both the parties are personally present. An application has been filed by the petitioner (Copy served ) stating therein that the case has amicably been settled between the parties and hence he is not inclined to proceed with the instant proceeding. Accordingly, the case be disposed of. In support of his contention the petitioner has stated on oath that he has no monetary claim.
 
            Accordingly, it appears that there is no impediment to dispose of the case in accordance with law.
 
            Proper fees have been paid .
 
Hence                                                 Ordered
 
that Malda D.F. Case No. 11/2007 stands dismissed on the ground of non-prosecution. The application signed by both the parties do form part of the order.
 
            Let a copy of this order be given to both the parties free of cost.
